1.PARTIES

This agreement is between Daylesford Mobile Sauna Pty Ltd ("the Company") and the undersigned

user ("the User") for the rental and use of the mobile woodfire sauna unit and trailer ("the Sauna").

 

2. SAUNA DELIVERY AND POSITIONING

2.1 The Company will deliver the Sauna to the location agreed to with the owner

of the property.

2.2 The Company will position the Sauna in a suitable location as determined by the Company's

operator in consultation with the User.

2.3 CRITICAL: Once positioned, the Sauna must NOT be moved or

relocated by the User or any third party.

 

3. PROHIBITION ON MOVING THE SAUNA

3.1 The User is strictly prohibited from moving, relocating, or attempting to move the Sauna trailer once it has been positioned on the premises.

3.2 Any damage to the Sauna, trailer, or associated equipment resulting from unauthorized movement

will be the sole responsibility of the User.

3.3 The User will be liable for all costs associated with repairs or

replacement if the Sauna is moved without authorization.

3.4 If the Sauna requires repositioning, the User must

contact the Company to arrange relocation.

4. ASSUMPTION OF RISK AND INDEMNIFICATION

4.1 The User acknowledges that the use of a woodfire sauna involves inherent risks including but not limited to burns from hot surfaces, dehydration, slips, trips, and falls.

4.2 The User voluntarily assumes all risks associated with the use of the Sauna and does so at their own risk.

4.3 The User agrees to indemnify and hold harmless Daylesford Mobile Sauna Pty Ltd, its directors, employees, contractors, and agents from and against all claims, damages, losses, costs, and expenses arising from or in connection with:

The User's use of the Sauna. Any injury, illness, or death occurring during the rental period. Any property damage caused by or related to the Sauna's use. Any breach of this agreement by the User

5. SAFETY RESPONSIBILITIES The User is responsible for ensuring all users of the Sauna are medically fit, not under the influence of alcohol or drugs, and follow safety instructions provided by the Company. Minors must be supervised.

6. ACKNOWLEDGMENT OF RISK AND HEALTH CONDITIONS

I understand that sauna use involves exposure to high heat and may present health risks such as

dehydration, dizziness, overheating, and aggravation of medical conditions. I acknowledge I have been advised to consult a physician before use if I have cardiovascular disease, respiratory problems, blood pressure issues, diabetes,

pregnancy, or any medical condition affected by heat.

 

7. RELEASE AND WAIVER OF LIABILITY I hereby release, waive, discharge, and hold harmless Daylesford Mobile Sauna Pty Ltd, its owners, employees, agents, and affiliates from any and all claims, liabilities, demands, or causes of action that may arise from my use of the sauna, including those arising from negligence.

8. TERMINATION The Company reserves the right to terminate this agreement and remove the Sauna immediately if the User breaches any terms of this agreement.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company's total liability under this agreement is limited to the rental fee paid by the User.

10. GOVERNING LAW

This agreement is governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

12. ACKNOWLEDGMENT

By signing below, the User acknowledges that they have read, understood, and agree to

be bound by all terms of this agreement.
